AI Regulations

China has become one of the first countries to attempt to regulate generative AI.

 

In July 2023, the Cyberspace Administration of China together with a number of other government regulators issued the Interim Measures for the Management of Generative Artificial Intelligence Services to regulate the provision of generative AI services.

 

The Measures apply to services available to the public in China. They will require the data used to instruct the systems to meet certain strict requirements. Technology being developed in connection with research or intended for overseas users will be exempted.  A cornerstone provision of the Measures is the requirement for generative AI service providers to conduct security reviews and register their algorithms

 

The Measures came into operation in August 2023. These followed earlier draft regulations issued for public consultation.

 

The Measures apply to entities planning to offer services domestically and this includes offshore entities intending to carry on business in in China.
